Nota Técnica sobre COVID-19 é alvo de críticas e pedidos de anulação

A Nota Técnica SEI nº 14127/2021/ME, publicada pela Subsecretaria de Inspeção do Trabalho, no final de março, que traz orientações sobre a elaboração de documentos e adoção de medidas de SST frente ao risco de contaminação pelo novo coronavírus no ambiente laboral está sendo alvo de críticas e pedidos de anulação pela Frente Ampla em Defesa da Saúde dos Trabalhadores. A nota, voltada principalmente aos auditores fiscais do Trabalho, pretende harmonizar o entendimento acerca das exigências da Portaria Conjunta SEPRT/MS nº 20/2020, especialmente quanto às dúvidas que surgiram em relação à necessidade de inclusão de tais documentos no PCMSO (Programa de Controle Médico de Saúde Ocupacional), à emissão de CAT (Comunicação de Acidente de Trabalho) em casos identificados de Covid-19, entre outros pontos.

“Ficamos impressionados com a publicação desta nota técnica porque ela extrapola o escopo de uma consulta. Ela praticamente rediscute a portaria conjunta, avançando para muito além de uma simples consulta. Ao avaliarmos a nota, não houve como identificar o escopo da consulta, nem o consultante, ou seja, sua origem, pois o sistema está com esta informação fechada. Vale lembrar que o SEI (Sistema Eletrônico de Informações) do Ministério da Economia é um instrumento de gestão de documentos e processos eletrônicos, utilizado para consultas e petições processuais, aberto para usuários internos e externos. Então, ficamos com a impressão de que a nota técnica acabou sendo usada para legislar, sem respeitar os ritos processuais devidos, e isso abre um perigoso precedente para a saúde e segurança dos trabalhadores”, avalia Márcia Bandini, professora da área de Saúde do Trabalhador do Departamento de Saúde Coletiva da UNICAMP e coordenadora do GT2 da Frente Ampla.

Diante disto, a Frente ampla em Defesa da Saúde dos Trabalhadores elegeu um Grupo de Trabalho multiprofissional que analisou o documento e emitiu uma nota de esclarecimentos  de interesse público sobre atecnia e ilegalidade da nota técnica SEI 14127/2021, que pode ser acessada aqui. “Defendemos a revogação imediata da nota técnica SEI 14.127 e que sejam feitos os devidos esclarecimentos sobre a motivação de sua publicação”, diz a médica.

PCMSO

Segundo Bandini, além do precedente de legislar indevidamente, a nota falha em questões técnicas referentes à saúde dos trabalhadores, minimizando a importância de medidas de proteção e prevenção contra a COVID-19. Para ela, existem basicamente três equívocos na Nota Técnica, todos desfavoráveis aos trabalhadores ou que criam dificuldades para a fiscalização no trabalho. O primeiro diz respeito a não inclusão das medidas de prevenção e controle da COVID-19 no PCMSO (Programa de Controle Médico de Saúde Ocupacional). Quanto a isto, a Frente Ampla destaca em sua nota: “o PCMSO deve ser obrigatoriamente abrangente, considerando as questões incidentes sobre o indivíduo e coletividade de trabalhadores, e planejado e implantado de acordo com os riscos à saúde dos trabalhadores, todos os riscos. Tendo em vista que a COVID-19 atinge severamente trabalhadores em seus locais de trabalho e/ou no deslocamento para o trabalho ou de retorno à sua residência, estando bem caracterizado o excesso de risco de seu acometimento, não há como legalmente desconsiderá-la no planejamento e implantação do PCMSO, em especial se considerarmos os critérios epidemiológicos previstos na NR-7”. A nota ainda destaca que a COVID-19 deve ser incorporada ao PCMSO para possibilitar o reconhecimento do perfil epidemiológico de adoecimento dos trabalhadores, permitindo, assim, a adoção e o aprimoramento das medidas de prevenção e proteção no trabalho. Com isto, a professora e médica do Trabalho observa que ao desvincular as ações previstas na Portaria do PCMSO e, subsidiariamente, também do PPRA, o documento fere a essência das NR-7 e NR-9.

TESTES

Outro equívoco apontado por Bandini diz respeito aos testes laboratoriais. A Nota Técnica afirma que quanto aos testes sorológicos ou moleculares para COVID-19 fica estipulado que eles não se enquadram entre os exames médicos complementares que devem ser incluídos no PCMSO, uma vez que não estão previstos nos itens da NR 7. “É quase ofensivo quando a nota técnica afirma isto. Obviamente que não estaria na NR-7, visto se tratar de doença nova. Porém, o PCMSO estabelece os parâmetros mínimos, que podem e devem ser expandidos com o objetivo de promover e preservar a saúde dos trabalhadores”, diz. Para ela, a nota desconsidera ainda boas práticas sobre o uso de testes laboratoriais, inclusive reconhecidas e recomendadas internacionalmente. “Por exemplo, o CDC (Centers for Disease Control and Prevention) norte-americano recomenda o uso de testes para identificação de casos e como meio de prevenir novas transmissões nos ambientes de trabalho. Mas é importante ressaltar que defendemos o uso adequado dos testes para fins de bloqueio epidemiológico. Por isto, esclarecemos que não recomendamos o uso de testes para retornos precoces ao trabalho, ou seja, retornos em intervalos menores de 14 dias de afastamento, período no qual pode haver transmissão do vírus SARS-CoV-2”.

RECONHECIMENTO

O documento da Frente Ampla destaca, ainda, que Nota Técnica desconsidera várias orientações técnicas que reconhecem a COVID-19 como potencial doença relacionada ao trabalho, como as publicadas pela própria Frente, pela Occupational Medicine, OMS (Organização Mundial da Saúde), ISSA (International Social Security Association), e o Conselho Nacional de Saúde no Brasil, dentre outras.

O terceiro equívoco apontado por Bandini, é que a Nota Técnica preconiza o cumprimento das ações previstas na Portaria Conjunta nº 20, que pode ajudar, mas não garante que casos de COVID-19 entre trabalhadores não possam ser caracterizados como relacionados ao trabalho. Também não invalidam obrigações dos empregadores e tomadores de serviço com a investigação, estabelecimento da relação do adoecimento com o trabalho, a emissão da respectiva CAT e a posterior tomada de medidas preventivas. “Parece ser mais uma tentativa de refutar o reconhecimento da COVID-19 como uma doença relacionada ao trabalho e, dessa forma, obstruir o acesso dos trabalhadores aos direitos trabalhistas e previdenciários”, resume.
