Saiu hoje, 11 de novembro, no Diário Oficial da União, o Decreto nº 10.854 que regulamenta disposições à legislação trabalhista e inclui o Programa Permanente de Consolidação, Simplificação e Desburocratização de Normas Trabalhista Infralegais. Entre os tópicos da publicação, para o setor de Saúde e Segurança no Trabalho, há alguns pontos importantes que abordam sobre a fiscalização das normas de proteção ao trabalho e de SST, as diretrizes para elaboração e revisão das Normas Regulamentadoras e o CA (Certificado de Aprovação) do Equipamento de Proteção Individual.
O decreto foi assinado ontem, dia 10, durante o evento de Consolidação do Marco Regulatório Trabalhista Infralegal, realizado no Palácio do Planalto, em Brasília/DF, que reuniu o presidente Jair Bolsonaro, o ministro da Economia Paulo Guedes e o ministro do Trabalho e Previdência Onyx Lorenzoni.
O documento traz ainda informações preliminares sobre o Prêmio Nacional Trabalhista, que tem por finalidade estimular a pesquisa nas áreas de direito do trabalho, segurança e saúde no trabalho, economia do trabalho, auditoria-fiscal do trabalho, além de temas correlatos a serem estabelecidos pelo Ministério do Trabalho e Previdência.

FISCALIZAÇÃO
De acordo com o decreto, compete exclusivamente aos Auditores-Fiscais do Trabalho, a fiscalização do cumprimento das normas de proteção ao trabalho e de SST incluindo denúncias irregulares e dos pedidos de fiscalização trabalhista, atuação estratégica e preventiva da inspeção do trabalho e autuação pela inspeção do trabalho.
Sobre as denúncias, a Subsecretaria de Inspeção de Trabalho as receberá por meio de canais eletrônicos que poderão ser utilizados pelos trabalhadores, órgãos e entidades (públicas, sindicais, privadas) e outros interessados. As acusações sobre irregularidades trabalhistas e pedidos de fiscalização serão recebidas e tratadas pela inspeção do trabalho, e poderão ser utilizadas como fonte de informações nas fases de elaboração e execução do seu planejamento. Além disto, poderão ter prioridade situações específicas que envolvam indícios de risco grave e iminente à segurança e à saúde de trabalhadores; ausência de pagamento de salário; trabalho infantil ou trabalho análogo ao de escravo.
O texto refere ainda que o planejamento da inspeção do trabalho contemplará atuação estratégica por meio de ações especiais setoriais para a prevenção de acidentes de trabalho, de doenças relacionadas ao trabalho e de irregularidades trabalhistas, a partir da análise dos dados de acidentalidade e adoecimento ocupacionais e do mercado de trabalho.
Ainda de acordo com o decreto, sobre o item que aborda o processo de autuação, incumbe exclusivamente à autoridade máxima regional em matéria de inspeção do trabalho, a aplicação de multas. O auto de infração lavrado pelo Auditor-Fiscal do Trabalho deverá indicar expressamente os dispositivos legais e infralegais ou as cláusulas de instrumentos coletivos que houverem sido infringidos. Além disto, é vedado ao Auditor-Fiscal determinar o cumprimento de exigências que constem apenas de manuais, notas técnicas, ofícios circulares ou atos congêneres.
NORMAS REGULAMENTADORAS
No texto do decreto também são apresentadas as diretrizes para a elaboração e revisão das Normas Regulamentadoras de SST, conforme itens destacados abaixo:
redução dos riscos inerentes ao trabalho, prevenção de acidentes de trabalho e doenças ocupacionais e promoção da segurança e saúde do trabalhador;
a dignidade da pessoa humana, o valor social do trabalho, a valorização do trabalho humano, o livre exercício da atividade econômica e a busca do pleno emprego, nos termos do disposto nos incisos III e IV do caput do art. 1º e nos incisos IV e VIII do caput do art. 170 da Constituição;
o embasamento técnico ou científico, a atualidade das normas com o estágio corrente de desenvolvimento tecnológico e a compatibilidade dos marcos regulatórios brasileiro e internacionais;
a harmonização, a consistência, a praticidade, a coerência e a uniformização das normas;
a transparência, a razoabilidade e a proporcionalidade no exercício da competência normativa;
a simplificação e a desburocratização do conteúdo das normas regulamentadoras; e a intervenção subsidiária e excepcional do Estado sobre o exercício de atividades econômicas, nos termos do disposto no inciso III do caput do art. 2º da Lei nº 13.874, de 2019, incluído o tratamento diferenciado à atividade econômica de baixo risco à saúde e à segurança no ambiente de trabalho.
Ainda de acordo com a publicação, são vedadas as seguintes condutas na elaboração e na revisão de normas regulamentadoras, exceto se em estrito cumprimento à previsão legal: criar reserva de mercado ao favorecer segmento econômico em detrimento de concorrentes; exigir especificação técnica que não seja necessária para atingir o fim pretendido; e redigir enunciados que impeçam ou retardem a inovação e a adoção de novas tecnologias, processos ou modelos de negócios.
Outro ponto importante é sobre a elaboração e a revisão das NRs que incluirão mecanismos de consulta à sociedade em geral e às organizações sindicais mais representativas de trabalhadores e empregadores, seja por meio de procedimentos de audiência e consulta pública, seja por consulta à Comissão Tripartite Paritária Permanente.
CERTIFICADO DE APROVAÇÃO
O Equipamento de Proteção Individual somente poderá ser comercializado com a obtenção do Certificado de Aprovação. Conforme o decreto, o ato do Ministro de Estado do Trabalho e Previdência disporá sobre os procedimentos e os requisitos técnicos para emissão, renovação ou alteração do CA. Essa emissão será feita por meio de sistema eletrônico simplificado e as informações prestadas e as documentações e os relatórios apresentados serão de responsabilidade do requerente e serão considerados.
