Foram publicadas dia 8 de outubro, no Diário Oficial da União, as portarias com os novos textos das Normas Regulamentadoras que foram assinadas na Cerimônia de Modernização de Normas de Segurança e Saúde no Trabalho. Este evento foi realizado dia 7, no Salão Nobre do Palácio do Planalto, em Brasília/DF, com a presença do Presidente Jair Bolsonaro, do Ministro do Trabalho e Previdência Onyx Lorenzoni, entre outros ministros, parlamentares e profissionais da área de SST que participaram do processo de revisão das normas.
O secretário executivo do Ministério do Trabalho e Previdência, Bruno Dalcolmo, destacou ontem durante a cerimônia, que o processo de revisão destas normas foi conduzido com responsabilidade, transparência e consenso entre trabalhadores e empregadores. “Em números, foram 22 consultas públicas com mais de 20 mil contribuições, entre centenas de reuniões com as bancadas de trabalhadores e empregadores de todos os setores neste processo de revisão que possui em torno de 95% de consenso. Mais da metade dos normativos já foram atualizados e harmonizados com o que há de melhor no mundo”, salienta Dalcomo.
Assinados novos textos das NRs 5, 17, 19, 30 e anexos das NRs 9 e 12
NOVAS NORMAS
As portarias apresentaram os novos textos das Normas Regulamentadoras nº 5 (CIPA), 17 (Ergonomia), 19 (Explosivos), 30 (Segurança e Saúde no Trabalho Aquaviário).
A Portaria MPT nº 422, de 7 de outubro, aprovou a nova redação da NR 5. De acordo com informações do Ministério do Trabalho e Previdência, uma das principais novidades desta norma é a potencial diminuição de conflitos trabalhistas incluindo uma definição sobre o término do contrato de trabalho por prazo determinado, já consolidada na jurisprudência. O fim do contrato, nesse caso, não caracteriza dispensa arbitrária ou sem justa causa do empregado eleito para cargo de direção da CIPA.
Além disso, haverá uma redução da burocracia no processo eleitoral das CIPAs. Outra inovação é a possibilidade de reuniões no formato EaD, sem a obrigatoriedade de reuniões presenciais. O formato virtual também poderá ser usado para capacitação, com uma economia estimada de R$ 100 milhões. A redução da carga horária para as capacitações, a depender do grau de risco, também vai gerar uma economia na casa dos R$ 100 milhões.
A Portaria MPT nº 423, de 7 de outubro, trouxe o novo texto da NR 17. Tratando da questão da ergonomia, a NR 17 traz uma importante atualização em relação ao papel da Análise Ergonômica do Trabalho (AET). Conforme o Ministério do Trabalho e Previdência, foram previstas duas etapas de avaliação: uma etapa preliminar e uma etapa de aprofundamento. A etapa preliminar corresponde à “avaliação ergonômica preliminar” e a de aprofundamento, à “Análise Ergonômica do Trabalho – AET”. Antes, toda e qualquer análise do posto de trabalho era realizada por meio da AET. Com o novo texto, procurou-se privilegiar uma avaliação ergonômica preliminar para as situações de trabalho visando à adoção de medidas de prevenção e de adaptação das condições de trabalho por todas as organizações. A AET, como processo mais complexo, ficou restrita a algumas hipóteses previstas na norma. Estudos realizados pela Firjan estimam que o potencial de economia com a atualização desta NR pode chegar a R$ 10,6 bilhões.
O novo texto da NR 19 foi publicado na Portaria MTP nº 424, de 7 de outubro. Esta norma dispõe sobre os requisitos e as medidas de prevenção para garantir as condições de segurança e saúde dos trabalhadores em todas as etapas da fabricação, manuseio, armazenamento e transporte de explosivos. Uma das principais inovações da NR 19 é o alinhamento com o normativo do Comando Logístico do Exército, atualizado em 2019, de forma a definir que as áreas perigosas de fábricas de explosivos deverão ter monitoramento eletrônico permanente, bem como o enquadramento correto de substâncias quando são inflamáveis.
E a Portaria MTP nº 425, de 7 de outubro, publicou a revisão da NR 30, que estabelece requisitos para a proteção e o resguardo da Segurança e da Saúde no Trabalho Aquaviário. Esta atualização de texto levou em consideração o preenchimento de lacuna regulamentar referente à gestão dos riscos, à resolução de conflito normativo.
Todas as portarias entram em vigor no dia 3 de janeiro de 2022.

Além dos novos textos das NRs, também foram publicados hoje no DOU, as redações dos Anexos 1 (Vibração) e 3 (Calor) da NR 9 (Avaliação e Controle de Exposições Ocupacionais a Agentes Físicos, Químicos e Biológicos) pela Portaria nº 426; o Anexo 3 (Meios de Acesso) da NR 12 (Máquinas e Equipamentos) pela Portaria nº 427; e Anexo 4 (Exposição Ocupacional ao Benzeno em Postos de Serviços Revendedores de Combustíveis Automotivos) da NR 20 (Segurança e Saúde no Trabalho com Inflamáveis e Combustíveis), que anteriormente estava presente como Anexo 2 na NR 9, pela Portaria nº 428.
Os anexos das NRs também entram em vigor no dia 3 de janeiro de 2022.

Também foram publicadas no DOU, as Consultas Públicas anunciadas durante a Cerimônia de Modernização de Normas de Segurança e Saúde no Trabalho. O Aviso de Consulta Pública nº 1 submete o novo texto da NR 13 (Caldeiras, Vasos de Pressão, Tubulações e Tanques Metálicos de Armazenamento). O Aviso nº 2 trata sobre a nova redação da NR 33 (Segurança e Saúde no Trabalho em Espaços Confinados). Já o Aviso nº 3 aborda o novo texto da NR 36 (Segurança e Saúde no Trabalho em Empresas de Abate e Processamento de Carnes e Derivados).

As consultas ficarão disponível por 30 dias e as contribuições deverão ser realizadas diretamente na plataforma disponível no endereço indicado para cada NR. Dúvidas quanto à participação devem ser enviadas para o correio eletrônico normatizacao.sit@economia.gov.br.
Expirado o prazo fixado, as sugestões serão analisadas pela Secretaria de Trabalho, que elaborará a proposta de texto a ser encaminhada a Grupo Técnico Tripartite, formado por representantes do governo, de trabalhadores e empregadores, para discussão e aprovação. Ao final, o grupo tripartite encaminhará a proposta de texto final a ser discutida no âmbito da CTPP (Comissão Tripartite Paritária Permanente).
